snow storm = damage

Driving home it just started raining and out of nowhere I see a Honda civic just spinning past me and eventually into me. Sooooo mad I just got the car 2 months ago

I know its gonna be fixed but is there a way to get compensation for money lost because now the car will have a accident on file thru car fax and u don't expect to pay the same between a car that has been hit and one that does not ?

I am pretty sure you can get paid for lost value (Diminished Value, I believe is the official term). That sucks though. Really, really sucks.

look at the bright side, the fender is a plastic part. I would have been way more upset if it was the door! Plastic wont rust. Good luck!

It's called diminished value, but the law governing it varies from state to state. It typically is difficult to recuperate. You can expect the insurance company to deny the diminished value claim, and you need to consult your lawyer if you decide you want to recover it.

That's what I thought they will try to deny anything the will say well its fixed to manufacturer aspect so it did not lose value .
Then lawyer will take half so I'll just try to settle with them if possible. Will see what happens when the adjuster gets here

That sucks....

Shouldn't say that, but did any part of the wheel and drivetrain get touched? If it's the case, I suggest you be there when the evaluator inspect it and I would push hard to scrap as much parts as you can... Then, ask to manage the repairs yourself and choose wisely. (read between the lines)

I don't think so because I was able to drive it home which was the scariest 45 min drive hoping not another person was gona do it again. But I will take it to BMW here in town and have them look at it before the adjuster gets here

Worst thing you can do.

Ask for an inspection asap. If you go to BMW, you'll end up with exactly the opposite of what you want... They'll jump on that repair and tell you they'll handle it, then bill the insurance company whatever they feel like...

-do you best to notice and write down any blemishes and damaged parts. Your wheel could be misaligned for exemple ($$), just say it pulls to the left, a steering wobble... whatever...

-get it inspected by the insurance and give "your" report of the damages to the guy doing it.

-Categorically refuse the first numbers the insurance company will give you

-Ask to "manage" the repairs yourself

-Then do what you need to do to put the car back in shape, managing your costs.

Only tips I can give you.
