Need help with air filter housing

So for a while now I've had a gap in my air filter housing due to a striped hole. And thanks to horrible service from a local BMW dealer last year who lied and said the part was replaced I found out after my warranty expired that it was not actually replaced and after back and for arguing with their higher ups I have up and decided to try finding a used on from someone who SCd. I then decided to fill the hole with epoxy and retread with the self tapping screw. After putting it all back together I realized the housing just won't close around the small intake elbow coming from the grills, it's as if it's just too thick. Has anyone else had this problem? Any ideas or advice? I feel like even if I sprung for a new part it still won't wrap around that elbow and will just once again strip the hole. All parts are stock except for the BMC air filter

are you sure the intake is sitting properly in the intake box? I have some issues were the intake would pushed forward too much (adjust the elbow piece) Because if everything is lined up the box should sit flush and missing one screw will not kill you. Try taking the little nipple out and see how the intake sits and how the lid sits as well.

I was out last night messing around with it again. There's plenty of space around the intake and filter itself it even has a lil wiggle. I've found this piece to be the problem

It's as if it's the wrong part. It's way to big for the box to close around it. It's even got creases from being slightly crushed to try fitting the box. Is there a similar part in any other Ms or other 3 series that the horrible dealer I used to go to lost the original part and threw that in? I'd just rather avoid the intake sucking in hot engine bay air from the gap

your intake looks to be pushed a bit. I can tell by the spot where the elbow that connects to the stock intake. i would try to get it to sit better. the connector to the intake should sit flush to the top. I will take some pictures of a mock setup (I am not running my stock intake) and post

Thank you
I should mention the right most screw in the pic isn't screwed into the bottom, it can't reach the bottom half around the circled part, so that's why there's a gap at the intake elbow too

That small piece is supposed to fit over tip not in the bigger intake box opening

To make sure all the parts can fit together properly take all of them off of the car and see if they join properly. Sometimes it looks like you are snapping them together correctly but there may be something pushing against it that you don't realize

Incorrect - notice that his box, there are two lips, because he tried to shove the smaller elbow into the box. On the EAS photo you can only see one lip, because the little elbow goes OVER the airbox. It's a huge PITA to get back together right, I even pointed out awhile back, that some of the intake videos showed assembling it incorrectly.

Anyway, that piece has to go OVER the airbox lid, otherwise, it won't fit.
