So this morning on my way to work, this lady decides to bust a Michigan left in front of me, needless to say I predicted her lane change wrong and ended up in a curb... there's a huge chunk of wheel missing, my alignment's messed up, I get the Chassis Stabilization Malfunction / xDrive gone bad messages...

I have over a half full tank of 45% e85 + 55% 93 gas in... and I have to take it in to the dealer. Car's still under warranty so I'd like to keep it that way... it's currently running in my driveway... There's no conceivable way to siphon the gas before taking my tune off and returning it back to stock. I tried removing the fuel pump... the metal ring will not come off; I can't siphon the gas because of this stupid anti-siphon grate thing. It's been running for an hour and the needle hasn't moved.

So my question is... by my calculations, if I fill the tank up, I'll have about 27% ethanol content inside; can I run a stock N55 with that much ethanol? What's going to happen?

Any other suggestions to this conundrum? I'd really like to get it into the dealer today although I doubt I have any time left... this fucking sucks.

That blows dude. What are you concerned about regarding the e85? There's no code that says "warning: this guy is running e85."
That being said, I believe that the consensus is that you can run ~20% e85 without a tune. My buddy ran 50% without a tune, and nothing bad happened.

Is there a way to unplug your injectors and get to the fuel rail in order to take some gas out that way?

Umm...what would your warranty cover? You had an accident, that is why you have insurance. The dealer isn't going to fix anything for you as it was not a failure due to workmanship or defect from the factory. Time to call you insurance and file a claim.

I'm aware of that but if the dealer looks at my car and they see I have a tune they'll void my warranty.

then why are you going to the dealer to fix the car? Just get it fixed at a reputable independent shop.

+1, exactly. Have you opened a claim with your insurance yet? If not you will be on the hook for any and all diagnostic fees that the dealer will charge you just to look at it.

Your first step is to call your insurance. You may need to file a police report but maybe not since this was a single vehicle accident.

Then your insurance will send an adjuster out to inspect your car and write up your claim. They will give you the option to either go to one of their preferred shops or cut you a check to take it to a shop of your choosing (you have this right).

Find a good BMW specialist in your area and bring the car to them. They will handle any interaction with your insurance for additional claims or adjustments based on damage assessment once the dis-assembly begins.

The dealer will not be able to do anything for you on this anyway. They do not do collision repairs. They typically farm that work out to a local shop that can handle that kind of work.

I just had the same issue, water pump went and I had 1/2 tank of E43 in it. I filled up with 93 and it ran fine. I actually drove it a little bit with E43 in it and it ran fine, but did not boost it. Leave the E45 in the tank and fill it with 93 and they will never know.

Thats an insurance claim which has nothing to do with warranty. Good luck man and it always sucks to have your ride down and out. Call up the insurance and get it handled.

A police officer came to the scene, I called 911, and a police report was filed. He said straight up she failed to yield at the stop sign so it's her fault.

I already called insurance too and unfortunately I don't have rental coverage... so that's gonna suck, and my deductible is $1,000... So I found out that I have to most likely take the car to a bodyshop... also talked to 2 service managers from 2 different dealerships and asked a "hypothetical" question: if a friend of a friend would bring their car in for a regular checkup/oil change... what would you do if they had a tune on? One of them said they hadn't revoked anyone's warranty in the 14 years they worked on cars for any modifications. The other said that it would be fine as long as it didn't mess with anything they were doing. Both of them said that they would only void the warranty if the tune had a direct impact on a part that broke.

I drove around for an hour hoping I would get rid of some of the gas (until I heard that)... and I only got rid of 1/10th of the tank hahaha

Well one thing is, you should stop driving around in a car with damaged suspension. As for insurance, did you get her information? It is normally easier to go through your insurance and then have them pursue the other person's insurance. That way you are working with an advocate rather than an adversary in getting your car repaired. You do need to pay your deductable but they will refund that when they get paid by the other insurance.

You may want to look at your insurance policy and adjust your deductibles if you can't swing the current setup and also add rental coverage. Obviously that will not help your current situation but it will be a a good thing for the future. You should always set your deductibles to something you can afford and set that money aside for if/when you do need it.

Well I would like to get my money back, it wasn't my fault she wasn't paying attention.

Car's already at the shop, they gave me an Altima for $25/day which I thought was pretty good! I forgot how much plastic went into ricers though lol.

Camber on rear right wheel is super positive, head lamp is broken, rear right lift point sheared off, underbody on the right side is nonexistent.

Call your insurance and check if any of the independent shops in your area are authorized and take it to them. Not sure why you are screwing around with the dealer.

Talked to insurance, took the car to a bodyshop that's authorized, (it's actually owned by a dealer apparently); they said they don't care about the tune, so it's all good. I'm afraid there's a lot of damage to the car though...

Your insurance will go after the lady.
Here in Ca., when I am in an accident I get the other guy's ins on the spot.
I call them to make a claim first.
Only if I have an issue do I file one with my ins.

Anyway, her ins should cover your deductible and a rental.

Be sure her insurance is going to pick up the tab for that rental. Sometimes the other party's insurance won't cover a rental if you don't have it in YOUR policy. Don't cheap out on insurance people. My policy includes rental at $20 for 6 months. If you can't afford that, you can't afford the $50,000 car. And what is up with that $1000 deductible? Either you are very young and just trying to get a policy at less than $5000 a year or you have so much money that $1000 is nothing to you. Based on the nature of your post, I'm going with the former. If a fender bender in your car suddenly causes a crisis over your mods and your warranty, maybe you can't afford the car?
