E90 Stock Suspension. Will 19x9.5 Rear +33 Offset with a 265/35/19 rub?

I just ordered a set of rims Front is 19x8.5 +35 and rears are 19x9.5 +33
I am wondering if I can do a 245/45/19 in the front and a 265/35/19 in the rear. I know it calls for a 265/30/19 but I live in NJ where there are massive potholes. Ive read many of the forums and see that many people that have sport suspension or lowered suspension and run a 265/30/19 no problem but my question is since I am at stock height which is usually an inch higher then sport will I rub with a 265/35/19 in the rear with a 33 offset and a 19x9.5 inch rim?

If you have stock suspension--not sport--you should be fine, unless you really load up in the back or trunk. If you do the math, the 5% difference between 260/30 and 265/30 is 13mm which equates to about half an inch. As the stock suspension is about an inch higher, as you said, you'll have plenty of room.

Don't do the 265/35, do the 275/30 instead. The 265/35 are too tall compared to the 235/35 fronts and the 275/30s will give you a little more sidewall without rubbing as well.

Well I am definitely running 245/35/19 in the front but even with stock suspension 265/35/19 it will rub?

It is not particularly about rubbing it is about correct tire sizing. The 245/35-19 is 654 mm tall (~26 inches tall). The 265/35-19 is 668 mm tall (26.6 inches tall). That is a big difference front to rear and will cause a decent amount of speedo error considering the 265/35 is about an inch taller than stock (255/35-18). The 275/30-19 is 647 mm tall (~25.75 inches tall) which is much closer to the 245/35 and the stock tire diameter. The 265/35 will make the car look jacked up in the rear.
