Won ebay auction at 55.1K for GT-R, Honda of San Marcos refusing to honor

I won eBay auction item number 220823902975. I spent hours to watch this auction and won it at $55,100 sunday afternoon. As soon as I won I sent a email asking how would I make the deposit for the car. Monday Morning I called since I did not get a response. I talked with a Chelsea who took my call at 10am today (8/8/2011) I ask to speak with their internet sales person which is Randy. She tried to get me to Randy and finally said that he is there but refusing to take my call. I left a message with her to let him know that I am the winner of the auction and want to make the deposit and arrange pickup date. A hour later another guy called me said they are not going to sell me the car as Randy made a mistake and is out of town when earlier I was advised he was refusing my call and he is there. I advised I was unhappy that they are not going to honor the price and asked to speak to someone higher. He directed me to Ian at 512-392-1313. I called Ian and he said that they are not going to sell me the car for the price I won it at and if I want the car I will have to pay the price their asking of $59k.

I feel as what this dealership is a violation of Consumer Protection laws.

So far I have reported this to BBB, Federal Trade Commission, Texas department of motors, Texas's attorney's office.

I forgot to mention I called eBay and they said that the dealer has violated their rules. One they did not list the car with a reserve nor did they say that they have the right to sell the car to anyone or cancel any bid. So I filed a eBay claim as well.

well the auction is a legally binding contract. many other cases like this have popped up on the internet over the years. with a little patience, diligence, media exposure, and an attorney, you'll eventually get your car, but i wouldn't classify that as a 'deal of the century' like some of the other ebay flub cars i've seen. i own a gtr btw, so i know what their values are.

You have 7 days to make full payment for the car. Make sure you do so, or they can cancel the sale.

Unfortunately, that may be your best bet to get the car - getting a lot of negative publicity for the dealer. eBay won't do shit for you.

This is on the eBay page for the car:

The winning bidder MUST make $500 eBay deposit within 24 hours or risk a no-sale default. Deposits are NON-REFUNDABLE unless vehicle has been misrepresented. The winning bid does NOT include tax title license... When the deposit has been submitted, "Buyer" MUST fax a copy of their valid, state-issued driver's license. The remaining balance must be paid within 3 Days. If payment is made by cashier's or personal check, we will hold all titles for 10 days or until funds have cleared.
