For sale: E90 335xi Le Mans Blue Black leather Aluminum Trim M-Sport Package w/ paddles Premium Package Steptronic Automatic tranny Nav Heated seats iPod USB adapter MSRP: $54975 (but will be selling a lot lower, obviously) 0 Miles. Literally. *UPDATE - PRICE & PHOTO* kbb says fair purchase price from dealer is $53,271.19 I'm looking to get something around mid-high $40's but I'm open to offers. sadly, i can't cancel the order.
it's a complicated story... anyways, it seems people are hesitant to buy the car, even though it will be brand new, never driven, never sat in, car. oh well... i don't want to lose my money, as i paid around $53,000 for the car.. sigh... i guess i'll find and do something about it. |

if you share your situation, maybe we can offer advice on how to get out of it. legally, the dealer can not keep a deposit or force you to take delivery of the car. not sure what circumstances you believe would cause you to lose your rights as a consumer. odds are, you haven't really lost those rights.

alright, i'll let you guys know the truth =X might be boring, some of you may think this is all bullshit and all, but here's the bare bone truth.
i bought 2008 e90 335xi. bought it around august, got delivery then around 3months after driving, the engine just stops working. i told the dealer and bmwna, and they agree to give back a new car at no cost. so i buy same color, same option, same priced 2009 e90 335xi. that's the car i'm driving right now. this car, is full of malfunctioning shit. i had 3 hpfp replaced, 6 injectors replaced, 5 software reinstall/upgrades, hydro pump and wastegate and oxygen pipe (?) replaced, both of my rear break lamps replaced, my corner lights replaced 4 times (first twice for light/ecu malfunction, twice for bulbs blowing), and MANY more. you get the idea. it's a lemon. so i go and tell the dealer and bmwna, and they are giving me a trade assist (something like a lemon, but not as good). so i HAVE to get a car within bmw model lineup. so i originally decided to go with F25 X3 35i Msport but that had a problem of its own. so just to get rid of all the troubles, i ordered yet another 2011 e90 335xi. however, to get this car, i had to trade in my car (for auction price so basically worth nothing) + pay extra for the MSRP differences + i had to pay extra of (current miles)/120,000*(MSRP of my current car) which adds up to a lot. but they are giving me a trade assist, which is a % discount off of the new car's MSRP. that's the basic story. you guys asked why can't i back out of the deal? here's my answer: 1. if i cancel, i'm left with a piece of malfunctioning expensive junk 2. if i back out, and just trade in for a different car, i won't get the trade assist so i'm just gona stick with and buy the car. but frankly, i am sick and tired of all the cars malfunctioning. as a result, i was looking to get rid of this new coming car, and buy myself a used 328 or something and save rest of the money for something else. if you have any more question/criticism, then let me know. p.s. sorry for the late reply. -Josh |

That said, what do you really want for the car? The only way you are going to sell it is to post a price that will get people interested. If MSRP is $54000 then the real selling price from a dealer would be in the $50k range. Accordingly, you'll have to offer a price below $50k to make it interesting - or else the buyer can just go straight to a dealer. |

It's the car not the dealer. I wish it wasn't true but BMW and turbos don't mix well on the 335' at least pre 2010's. No problems with 2011 335! I can't imagine life without my 335i

If the OP has an agreement with BMW (which he appears to have) then it is a done deal. He can no longer decide to try to lemon his car.
