What would you do if you were me?
I bought a new 2010 328xi ... update.
... and today I picked it up earlier than planned because the heavens parted and meetings were cancelled. All worked out spendidly and a better experience could not have been had. I thank you all for your suggestions. The SA and dealership came through (with flying colors) and I cannot be more happy. This board is great as are all of you that offered your comments, insights and suggestions. I'll post pictures soon! (Rain is coming...) This 328xi is amazing!! Simply amazing. I think I'll go out into the garage, again ... and just sit in it. Last edited by CJP2; 03-19-2010 at 10:43 PM.. |

Well, first of all, did they sign something stating they would deliver to you on a specific date? If not, they aren't obligated.
I would certainly try and get them to cover the costs, but I would be more concerned with how they are handling this with you as far as customer service (are they being apologetic, proactive, etc.). Taking a delivery a week later than originally planned doesn't sound like a horror story, I am sure a lot of people have experienced this. I was told my car would be ready first, second week of March and now I am being told 3/25. I am being patient though. |

Thanks mbhforum for your thoughts. No, they did not specifically state a delivery date. The SA has been a pretty straight-shooter and really decent fellow to work with. It's all been easy dealings until now. And you are right - it's not a horror story and patience helps. It's the principle of having to pay $$$ for additional shipping when the SA admitted they dropped the ball on this one. The 328xi is STILL in WI, so I have another day or so to mull it over.

Even if they don't cover the cost of shipping you may be able to swing discounted shipping or discounted swag at the merchaindise dept or a free oil change or something. Sometimes telling them you are disappointed, but such and such would make me feel better and forget about it (within reason) they may play ball. There is usually a survey after car sales and apparently BMW dealerships covet all 5's. This could be leverage. Its crappy but stuff like this happens. I doubt they are intentionally trying to put you in a bind. But again, they may not give you something for free, but at a discount...could be.

Definitely pound them on the survey if they don't help you out.

How BMW has changed in the last decade!
When I bought my '97 M3, the dealer didn't have exactly what I wanted (color), but she said she'd look around, and found one in NJ. I was in DC. Two days later, it was at her dealership. Note -- no contract, no shipping cost, nothing -- but I had told her in a handshake deal that we'd buy it after a look and test drive, subject to working out the price. So we did that, hammered out a deal, and that was that. These days, they nickle and dime you to death, cheap out on what's included with the car, and then want to stick you with a $500 shipping charge! And, try to deny you warranty coverage given any opportunity. All I can say is, that sucks! |

Unless you are willing or can walk away from the entire deal, you may be stuck with the $500 shipping cost. It definitely stinks though that they screwed up and didn't deliver as promised. But as someone else said, unless there was a written/signed agreement, you may be stuck will the bill.
That's a terrible way to run a business though! Just let them know that they will lose a lot more than the $500 IF they make you pay for it; ie., no referrals, no future business, and worst of all....bad word of mouth. If they don't get this, they just are plain stupid and don't deserve your business.

What dealership is it?
Ask them to split it and give you a BMW loaner until it arrives. (If you didn't trade it, tell them you already sold your other car and have nothing to drive.)

Oh also, this is interesting - when I was looking at cars (this was like 6 years ago though) I was looking for a CPO used coupe. I found one in another state (don't remember) and the SA told me that they can't bring in cars from other dealerships.
Guess he was full of it - I wonder why he said that to me... Good luck.

Not sure where in WI the dealer is, Appleton maybe?
It is about seven hours from you. Why not rent a one way rental car and go get it your self. I did that on a Porsche 911 and had a great "break in" drive back. |

+1. I don't care if they didn't promise it in writing or not. The dealer gave his word and you paid a (hefty) sum. Shoot, I once demanded money back from USPS for not making the "next day delivery" on time. For $500 you should definitely demand it back. Dinging them on the survey is not enough (you may never get it! I didn't - but that's a whole other story!).

[QUOTE=CJP2;6911134]Thanks mbhforum for your thoughts. No, they did not specifically state a delivery date.
They didnt specifically state a delivery date huh? Well what do you want them to do? You are still going to get the car although it wont be untill a week after you wanted. I can pretty much gauruntee that there were some unforseen circumstances along the line somewhere that wasnt seen untill the last minute with the delivery people and they had to prioritze their schedule in order of importance. They dont have to report to the dealer what exactly the problem that they had because they dont work "in house" with the dealer. But I wouldnt pay any extra for a new delivery date. You allready paid once for it. |

An additional $500 just to get a car from WI to St. Louis when buying from a dealer? Give me a freakin break.
Dealers trades cars all the time between dealerships and it should cost you nothing for shipping fees. When I brought my '99 Z28 with all of the options I wanted except leather seats, they didn't have one in their inventory so they searched the dealer network inventory and found one out of the state in my color. They traded one of their cars on the lot for it and I didn't have to pay anything extra. In this case, I would've told the dealer they have one week to get the car to me, no exceptations. If they fail to honor that, I would call my CC and dispute the deposit charge, call the bank and terminate the loan due to dealer failing to deliver the car. If the car wasn't available or has to be custom ordered, then that's understandable but still no go on the $500 shippers fee.

LOL.
To the OP though, you're probably stuck paying the 500. It does suck and you're right, the SA dropped the ball, but if there's no signed paperwork saying they'd have it to you by day X, just slam them for it on the survey.

CPO != new car. CPOs are used cars, and used cars are not generally swapped between dealerships. It's a lot more hairy.

If you need a car they should provide a loaner to you.
If not, They should cover the $500. If not then aske them to give you a $500 credit for service or goodies. If not then offer to split the $500. Or do what most 17 year olds suggest on these forums is to "SUE THE SHIT OUT FO THEM". Thats my favorite cuz 17 year olds think lawyers are free. Tell them your furious and they should throw you a bone for the incovienece. |

I would walk away, or at least threaten them to default on the deal.
Tell them it is like any relationship, yes, tough times will come, but if it starts off bad, it can only get worse... |

When the dealer is telling you you're in a contract they're probably blowing smoke up your a$$. You may well have some leverage here, whether you should use it is a fair point of argument. As much as I try to understand things happen, the fact that the car hasn't even been pickup up after the original delivery date would definitely upset me. Give us some specifics of what you've committed to and we can help more. |

They shipped my car across Canada and I didn't pay anything, though I would've paid if I had to. Once the deal was signed they had it here in a week. If I were you I wouldn't be upset, just ask for a loaner until it gets here and get them to toss in some free floor mats or something. No need to make a bad situation worse but express your concern to your SA and the GM and make sure you mention it in the survey.
