so, i didn't sleep last night... i was consumed with the days events. the thing that pissed me off the most is that i was assuming the accident was all my doing, and i was going to be getting an insurance surcharge... but my wife mentioned to me that the guy in the Subaru was actually going around me and was in the on-coming traffic lane... hmmm. perhaps there is a small silver lining to this... technically, he was on the wrong side passing, and i certainly did not expect him there. i'm holding out hope my and his insurance company see it this way and find neither of us more than 50% responsible ...there for making it a no fault accident which will not effect my insurance standing.
i did a small diagram of spot of the accident.... my fingers are crossed that AMICA sees it the same way.

and one side note... i love BMW, but this was a light fender bender... and yet, the headlight bracket broke away, the headlight washer broke, the wheel well liner cracked... they don't make them like they used to. my buddy owns a bodyshop... always complains about all the crap behind bumpers these day that get damaged, and that add so much repair cost. he was laughing at the new X5 the last time i saw him... he showed me how the bumper and fenders are all one piece now. one good front bumper hit and it damages the A pillar, the the door too. pretty bad design there.

, you should be able to win... I recommend you get an attorney if you already dont have one.. You can get damage money out of the other persons insurance since this would be their fault for trying to pass you in a parking lot WTF? I would have been fucking furious, would have gotten out the car and kicked the shit out of his door

I had an accident similar to yours. We were in a parking lot as well. I tried to over take a car in your position and the person started to drive as I was coming around to pass her. The cop came and no one got a ticket but my insurance claimed fault and paid for the person's repair. It was Farmers Insurance.

i couldn't be mad at him... i wasn't moving for a minute there was distracted by the woman commenting on my POS BMW and large nose....and he wanted to get around me. just bad timing and a bad break... i would have done the same as him.

in any other situation you would be the one at fault, but because this occured INSIDE a PARKING lot, the luck is on your side for this one and they will blame her, worst comes to worst itll be 50 50. This same thing occured to me and my friend as he was driving his car, we were the ones that passed, so we would be SUBI lol.

im sure ull come out the winner, you have to right? i mean after the shit satin gave you, you gota have something good headed your way, lifes events take some time to balance themselves out. And yea i do think you shoulda at least pissed on her door handles = )

i'm hoping for a little luck. it wasn'r her car i hit. some other guy in a subaru that was passing me... so, she got off scott free, and her A6 was safe and sound.

i agree... i was lucky it was just a car. bur i doubt he knew we were arguing.
if they they do blame me, well at least i tried.

plus... he was in the incoming side lane... so i totally understand why he did it, and don't blame him... he was not where he was supposed to be driving.... we'll see.
