Unhappy BMW f*cked me over this time

Needless to say , not the kind of service i expected from bmw...

To cut a long story short.

I came in the dealership a couple of weeks ago to dispose of my vanilla 330i ... Test drove a fully loaded e91 330xd and fell in love with it. Was considering ordering one (i want e90) and was told that a fully loaded one (CA, m-kit, blacklines) was coming in a couple of weeks time and was for sale.

So , i haggled over the price , got a 9% discount on invoice, and gave them a deposit.

The car had arrived and i was meant to pick it up tomorrow night. So i call them today, and guess what ??? Some fu*()* bas&*& came, saw the car and offered to pay invoice price, so they sold it to him !!

So no car now , but i told them ill get my lawyer on the case, and hope to be able to buy the car. I dont want to wait 3 months for an order again, so if i cant get the car, i will consider getting a merc


and i though me and my family were valuable customers? heck weve bought 8 cars from them in the last 5 years or so

WOW, I'd be super pissed if they sold my car, what about your deposit? Did they give it back to you, or offer you something else?

How do you know the other guy paid invoice for it? How do you know they sold it to someone else? I'd be mad to if I had to unexpectedly wait longer and pay more.

No. The deposit is a monetary commitment to purchase the car. It legally binds the dealer to hold the car for the person who placed the deposit at which time final price can be negotiated. IF the parties do not come to an arrangement regarding price, than the deposit will be returned and the dealer can now try to sell the car to whomever they wish. I direct you to the UCC for more info.

They can negotiate with other dealers to get you the car you want, and should be willing to be extremely nice about it. This happened to me at a Honda dealer -- I sold my car the week before I was supposed to pick up the Odyssey van I had been waiting 7 months for, and when I came in to get the van "it had been sold by mistake". All they did was provide a rental and then gave us one from the next month's allotment. I would suggest you try the 'nice' tactic first to see what they can do to make it right for you.

I suspect the dealer will have his way........... dont blame him a bit for selling the car at a greater profit. Props to the dealer for doing so.

(Im sorry to hear you bought a VAN.)

Funny thing about this is, if you were to have decided to not buy the car (having put a deposit down) i dont think the dealer would have had any problem keeping the deposit along with a little frustration for your "changed mind". So i just think its funny when its ok if the customer gets screwed....

BS. There's not props for a dealer like that, none. The dealer entered into a legally binding contract to sell the car, period. If he felt he could get more money for the car then he shouldn't have entered into an agreement, in the first place.

Make sure you report this to BMWNA and your state's Better Business Bureau, as well as talk to a lawer. Heck, if you have a local newspaper, tell them too. Nothing like bad publicity to get some good payback.

They still obligated to sell you a car at the agreed price. But hey, if someone came in with the money in hand at 9% more no kidding the car is going to him/her- ur just going to have to get the next car that comes. The dealer should have told you there was a mixup and your car is comming a little later than expect rather than tell you straight up that it was sold to someone else- you wouldn't be as pissed off that way.

I wouldn't do it to a customer who BOUGHT 8 BMW's from there if I owned the dealership. I run a business myself and that's just not right even if you make few more bucks

dude, you should definitely complain to BMW Bulgaria or even higher if necessary. that's completely absurd and wrong. plus, i'd make sure no one i know and will get to know will ever purchase a car from that dealership.

guys ive spoken to them again. The problem is the following . I bought the car from a dealership in Plovdiv (200km from my home), and the car was due to arrive at a dealership in my city... For some reason , they told me that there was a miscommunication between the two dealers, and the other dealer "put" the car for sale. As there is a shortage of e90s here in bulgaria. it was snapped up very quickly

im speaking on three fronts. Kamor, Mcar + bmw bulgaria.

There is no e90 in a similar spec that they can deliver before the end of JUNE ! Bulgaria is a small country with enough rich people. BMW's allocations get sold so quickly you wouldnt believe it... And the 330xd was going to be a very lucky buy

im gonna go there first thing monday morning and .... i dont know really

That's better than your dealership selling the car out from under you but I still feel you are entitled to some compensation for your aggravation and frustration, especially being a long time repeat customer. Just my 2 cents.

If they dont budge, you can always contact the headquarters and probably get them in a shit ton of trouble...

Reguardless of them selling it for a larger profit.
You ordered a car and gave a deposit on it, you have documentation proving this. Upon your delivery date, you find out your car has been sold to someone else and the dealership is doing nothing to help you in their mistake.
