Accident
morning all
not a great start to the week, waiting/indicating to turn into our office block, cyclist crashed into the back of my car due to wet/slippery road+his brakes failed! nice guy apologised and said it was his fault. at first glance just the rear passenger light is broken and needs completely changing, there are a few little marks and chips on the boot lid and bottom of the bumper. just wondering what would you do? get brand new light cluster from BMW which costs hundreds or a 2nd hand one from ebay and get it done like that. Don't want to go through insurance, not sure how does it even work if the other party was a cyclist! appreciate your thoughts

His brakes didn't fail. He'd likely be head down and not looking where he was going. Should be charged like you would be if you ran into the back of him.
Hope your car gets fixed promptly at his expense.

You'll go through insurance and pay for it. He wont have insurance as a cyclist and you'll pay for it over years to come.
I hope you got his details so you can get some cash from him. |

If he has agreed to pay just get a replacement part as cheap as possible and dont be a dick about it. Its when people push and push for more that everyone looses.
As for a new/used part that'd depend on the age of the car. If it was a 1 - 2 year old car I'd push for a new part. If it was a older car I'd be less worried and wouldn't want a brand new unit one side and an older unit the other as they might look odd. I've heard that Cotswold BMW parts department is one of the cheapest around so you might find getting it from a garage not that local is actually cheaper than you might think. I once reversed into a parked car ages back. I was parked in a space with cars either side of me and this guy just abandoned his car in a cross hatched "no parking" area and left me without enough room to move out. I tried, mis judged it and failed. We discussed the costs involved with no claims etc and agreed that I'd just pay the £150-200 to sort out his damage. My car was absolutely fine which was funny. He agreed and my no claims was not hit and nor was his. You will say "but his should have been fine".... I've spent enough time with two no fault accidents on my insurance and I assure you that it does impact it |

completely agree Chris and not trying to get anything extra! price for the light from BMW (checked with 3 dealers, prices for all 3 were the same, including Costswold) is not actually much more than ebay, so that would be new, but the dents and scrapes will be done by my local bodyshop.
I know accidents happen, so trying to be reasonable.

Great that he has put his hands up. His brakes may have failed as he said - I'm a cyclist and my disc brakes get contaminated from time to time and basically become worthless all of a sudden, it does happen.

You would need to declare it to your insurance company who would then deal with his insurance company. This means that he pays his excess, you pay yours.
You get your excess back as it was his fault but you will always have a "no fault claim" on your insurace (well, for the next 5 years). He can use his house insurance with personal liability cover in a lot of cases. If the cyclist didnt want to help he could just tell you to do one. You'd have to claim on your insurance, it'd still be his fault but nothing would come back to him unless you went the small claims route. You'd find your insurance company would certainly go in his favor anyway and they'd probably ask him if he suffered any whiplash Insurance companies will always tell you that it wont change the price of a premium but for shits and giggles just run two seperate quotes, one with 10yrs NCB and no accidents and another with the same 10yrs NCB but one no fault claim in the last 5 years and see which one is cheaper. You might want to find out how much his excess is and then figure out how much damage you've got to your car and see if there is a way of convincing them to pay cash. |

You don't have to go through your own insurance company. When I was rear ended the other persons insurance was straight into me and sorted everything out. Depends on the other insurance company I guess.

Dont tell him you'll pay it all but if he offers maybe his excess, lets say £200 you could say "look, you'll put your premium up by X amount each year too as you can't protect a no claim period on a house" you might be able to get a bit more.
He will have to pay an excess regardless and I know I'd rather pay to sort it rather than have a claim. |
