Accident

morning all

not a great start to the week, waiting/indicating to turn into our office block, cyclist crashed into the back of my car due to wet/slippery road+his brakes failed! nice guy apologised and said it was his fault. at first glance just the rear passenger light is broken and needs completely changing, there are a few little marks and chips on the boot lid and bottom of the bumper.

just wondering what would you do? get brand new light cluster from BMW which costs hundreds or a 2nd hand one from ebay and get it done like that. Don't want to go through insurance, not sure how does it even work if the other party was a cyclist!

Get the cyclist to pay for a full repair. Why wouldn't you?

His brakes didn't fail. He'd likely be head down and not looking where he was going. Should be charged like you would be if you ran into the back of him.
Hope your car gets fixed promptly at his expense.

You'll go through insurance and pay for it. He wont have insurance as a cyclist and you'll pay for it over years to come.

I hope you got his details so you can get some cash from him.

If he has agreed to pay just get a replacement part as cheap as possible and dont be a dick about it. Its when people push and push for more that everyone looses.
As for a new/used part that'd depend on the age of the car. If it was a 1 - 2 year old car I'd push for a new part. If it was a older car I'd be less worried and wouldn't want a brand new unit one side and an older unit the other as they might look odd.

I've heard that Cotswold BMW parts department is one of the cheapest around so you might find getting it from a garage not that local is actually cheaper than you might think.


I once reversed into a parked car ages back. I was parked in a space with cars either side of me and this guy just abandoned his car in a cross hatched "no parking" area and left me without enough room to move out. I tried, mis judged it and failed.
We discussed the costs involved with no claims etc and agreed that I'd just pay the £150-200 to sort out his damage. My car was absolutely fine which was funny.
He agreed and my no claims was not hit and nor was his.

You will say "but his should have been fine".... I've spent enough time with two no fault accidents on my insurance and I assure you that it does impact it

completely agree Chris and not trying to get anything extra! price for the light from BMW (checked with 3 dealers, prices for all 3 were the same, including Costswold) is not actually much more than ebay, so that would be new, but the dents and scrapes will be done by my local bodyshop.

I know accidents happen, so trying to be reasonable.

I don't think anyone is being "a dick about it".
The cyclist is to blame, and has agreed to pay for the damage. As the cyclist will probably have no insurance (he may have tho) , it should need to go go anywhere near the OP's insurance. All that needs to happen is the for the OP to get a quote for the damage to put the vehicle back as it was (no more) and for the cyclist to work out how to pay for it.

Great that he has put his hands up. His brakes may have failed as he said - I'm a cyclist and my disc brakes get contaminated from time to time and basically become worthless all of a sudden, it does happen.

as I said he is a nice chap and I felt sorry for him as he didn't intend to damage anything on his way to work, but it happens.

just one thing now, he wants to go through his insurance, I explained to him that most body shop's have different rates for private or insurance jobs, then there would be his excess to pay on top! how does that affect me? does my insurance need to know about this when I renew my policy? although there would be no claim through them? never done this before, so no idea what you are meant to do or not to do!

You would need to declare it to your insurance company who would then deal with his insurance company. This means that he pays his excess, you pay yours.

You get your excess back as it was his fault but you will always have a "no fault claim" on your insurace (well, for the next 5 years).

He can use his house insurance with personal liability cover in a lot of cases.

If the cyclist didnt want to help he could just tell you to do one. You'd have to claim on your insurance, it'd still be his fault but nothing would come back to him unless you went the small claims route.

You'd find your insurance company would certainly go in his favor anyway and they'd probably ask him if he suffered any whiplash

Insurance companies will always tell you that it wont change the price of a premium but for shits and giggles just run two seperate quotes, one with 10yrs NCB and no accidents and another with the same 10yrs NCB but one no fault claim in the last 5 years and see which one is cheaper.

You might want to find out how much his excess is and then figure out how much damage you've got to your car and see if there is a way of convincing them to pay cash.

in that case I rather pay out of my own pocket than going through the hassle of insurance!

You don't have to go through your own insurance company. When I was rear ended the other persons insurance was straight into me and sorted everything out. Depends on the other insurance company I guess.

Indeed you can .. although the accident and your details still go onto the insurance accident/claims database, even if you claim through the other persons insurance you still have to declare you've had an accident in the last 5 years. It goes down as a non fault claim all costs recovered from other party .. sadly and unfairly it still increases your premiums a little for the next few years.

At the end of the day if the other person admits liability it makes no difference come renewal time if you went through their insurance or your own as long as all costs are recovered, you will still legally need to declare exactly the same when looking for new quotes.

It sure is PITA as the light is £144 plus minor body damage touch up coming overall to about £360!

I'll get it done myself much easier

Dont tell him you'll pay it all but if he offers maybe his excess, lets say £200 you could say "look, you'll put your premium up by X amount each year too as you can't protect a no claim period on a house" you might be able to get a bit more.

He will have to pay an excess regardless and I know I'd rather pay to sort it rather than have a claim.
