Max tire size?

Ok currently in the tire shop getting 265 pss on my 2011 335D the mech came out and told me that my tire will rub on the inside frame without a spacer in there I find that hard to believe because I have a good bit of room does anyone know if I'll need a spacer or not I'm running pss 265/30/19 on a 19x9.5 inch rim

What is the offset on your rear wheels? If you're running a 9.5" wide rim a 265 should not be an issue and neither should the inside fender wall. For reference, I run a 19x9.5 ET33 and I'm lowered, but I have no rubbing issues whatsoever even with 4 people and luggage in the car. However, MPSS are also known to run a little bit wider than most tires so a 255 in MPSS might be a better move.
