Rear wheel rubbing

My ride is lowered 30mm. I just put 19" wheels on. The tyres are 265/30 - too wide i know. The passenger side doesn't rub but the driver side does. The other day was changing the sensor and noticed the spring upper pad had completely busted. I pulled it out and it was all dried up.
I was going to get the fender rolled, but if only one side is rubbing, I'm thinking it could be the now-missing upper pad (part 9 on the attached image).
Could the missing spring pad be causing the spring to collapse too much?

I'd replace upper pads on both sides before rolling the fenders. However, rolling will give you more clearance.

How many miles are on your car? I get the same rubbing on only the driver side and have been planning to roll the fenders but maybe I'm having the same problem. I have the stock suspension setup tho on my E92 with only 46K so i hope its still holding up.
