HELP! Stolen 335i E90 LeMan Blue from BMW of Las Vegas #findblueblair

Here are some pics from the aftermath

I'm a long time lurker on these forums and I wish I was writing to you all with better news but the title of this post says it all.

My beloved "Blue Blair" -- a 2011 BMW 335i Sedan E90 M-Sport with BMW Performance Edition fully loaded in beautiful LeMans Blue was stolen out of a garage while being serviced at BMW of Las Vegas.

Based on security camera footage, it was stolen sometime around 8:20pm on Monday Oct 10, 2016.

When I arrived at the dealership on Tuesday Oct 11, 2016 at 9am to pick up my car... they tell me that my car was missing!

I have contacted local police and filed stolen vehicle police report.

It has Nevada License plate# ****** with a license plate cover that says "Cal Alumni." In the rear drivers side window has a scripted "Cal" logo sticker and on the rear passengers side window has a "Berkeley Optometry" seal sticker. Stock M-Sport rims.

According to the dealer, there was no sign of forced entry, no windows broken, no garage door chains were broken so the car should be intact.

I think I'll put one of those GPS trackers in my car soon.

Would the dealer be responsible ?

So out of all the cars in the garage, yours was the only one stolen? Sorry to hear but I smell an inside job. Hope the dealer goes to bat for you.

That's a heck of an event to motivate your first post! Sorry to hear about this and hope all ends well. That is what insurance is for, but I hope it is recovered at mimimal loss.

I would think that since the car was on their lot that they would be held responsible for it.

Oh man that sucks a car like that u don't see everyday. But like most people said the dealer should be responsible. Unless they had let u signed a waiver saying they aren't responsible. But that's why we pay insurance, hopefully u get ur baby back

Fellow OD here. Sorry to hear about your car. Definitely smells like an inside job if there was no forced entry and it was stolen from their garage... Hopefully you get it back in one piece!

You should threaten to contact the news media and social media about how your car was stolen from inside the dealer garage and tell people to don't buy or service their car there if they keep ignoring you. Hopefully that will get a response from the dealership.

Sucks that happen... was your car the only car that was taken .. ? If not, then sounds like another gone in 60 secs movie... plz keep us updated w/ any news... this the first I heard, customer car is taken while the car is in for service.

Sorry to hear man, this is so unfortunate! You would think these cars would have some sort of tracking capabilities, like OnStar for example. I would have expected BMW to be able to track our vehicles in situations like this!

You pretty much need a tow truck nowadays in order to steal a car unless the thief has access to the keys somehow.

Depending on how this all resolves I plan to make a consumer alert so that everyone knows what becomes of my situation.

I was finally able to get in touch with the customer service director of BMW of Las Vegas.

***VERY IMPORTANT CONSUMER ALERT***
In short, they are denying any responsibility and WILL NOT pay for your car or help replace your car if any car is stolen under their care -- this is per the service agreement that you signed which essentially waives your right to any recourse and says they are not liable for any damages or stolen vehicles.

I want to make sure everyone knows this policy and is aware so that you can protect yourself next time you trust your vehicle to this dealership for care.

Now the issue is with insurance. Keep in mind if you DO NOT have comprehensive insurance you are out of luck. BMW of Las Vegas has the specific policy that you you signed when you drop off the car that relinquishes them from any liability due to stolen vehicles.

So lets say hypothetically you do have insurance, you may not want to make a claim on your insurance despite their claim that it will not affect your rates --- think about it -- it is still consider a loss and a payment on your account. If you constantly have stolen vehicle claims -- you don't they will cancel your insurance? My research tells me that it is best to not go through one's own personal insurance for this reason.

In terms of BMW Assist -- theoretically this car could have been tracked from the moment it was missing however due to delays in the dealership reporting the theft and delays from my local police department the activation of this stolen car feature tracking is still not enabled. This incident occurred on the evening of Monday Oct 10, 2016 --- time is not on our side...

If there are any questions, please do not hesitate to ask. I want to make sure everyone is aware of the policies of this dealership as well as the policies of most all repair shops.

I wonder where in their operating procedures it tells them to leave the keys in the car over night. This is ridiculous.

I have not personally seen the security footage -- all I know is what has been told to me by BMW of Las Vegas. I have not personally had the change to view the footage nor was I given the option to do so.

However I was able to confirm that it is standard operating procedure for BMW of Las Vegas to leave your car keys INSIDE THE CAR if it is parked in a "secured location." The location was obviously not secure because my car is missing. They may want to carefully review this policy to help prevent something like this from happening to someone else.

Imagine if you had a bentley... I imagine most dealership service policies are the same -- written by corporate lawyers to help reduce liability.

Everyone needs to know the risks for entrusting your property to dealerships.

This is a cause bigger than myself, bigger than getting back my meticulously cared for car -- it is a cause to raise awareness. I am an advocate every day of my life for my patients. My goal is to improve the life for others and helping others not have to go through the same difficulties. This issue is a systemic policy concern for consumers in terms of the policies of dealerships and repair shops.

The key phrase is "secured location." So they left my keys in my car because the location of the garage was considered a "secured location."
