are deposits refundable?
let's say you put down 3,000
then when the car is built you decide, not for you is it a breach of contract or will they refund you and be annoyed at you ? |

They are legally entitled to keep it, but depending how nice they are/persuasive you are/hot looking woman you are then it is possible to get it back, especially if you're going to buy another car from them.

If it's a new car and order form signed then once car is in production it's a Breach of contract and not entitled to refund I'm afraid.
If they feel the car is very sellable then they would be unfair not to offer a refund minus fair costs incurred. |

Also, if say you ordered a 316 and decided to go for a better spec but with same dealer they may transfer deposit and sell other separately.
If you have hacked them off or they are not looking to get repeat business, then very slim chance. Alternatively, get a note from your doctors citing you as insane and it's not a valid contract The latter should be easy for you to pull off |

I ordered a f31 330d s drive but pre production changed my mind to a 335d.
I then wanted to add some extra options like m sport + package but car had already gone into production. Dealer agreed to swallow that car for showroom and reordered my final version without affecting £500 deposit. Great salesman (dave Chaplin) and dealership (bluebell CREWE) |

The deposit you put down for ordering is not the same in my head as the deposit you pay as up front payment, as when finance agreements described.
So I think normally you only pay a few hundred when you order, and the remaining when the car is about to be delivered.

1k down and the remaining deposit of 500 at time of delivery.
I was made aware that cancellation would mean I could lose my 1k deposit, read the T&Cs on the back of the invoice to know your rights... one thing to point out, if they delay delivery beyond 30 days past the estimated delivery at the time of ordering you can cancel in writing and get full deposit back (unless they deliver in 7 days). I made good use of that policy |

say your financial circumstances changed? lost your job etc I get that they would be annoyed but if you never got the car? |

Never mind the deposit, they can make you pay for the entire amount of credit you signed for, once you sign the contract the cars is yours

I think you are all wrong
Here is an extract from a thread on babybmw from TRL who is a BMW sales manager. I think he posts on here 2!? Anyway what he said on the matter! "Tame Sales Manager here..... its a load of As Spud stated, a deposit has to be refunded unless the dealer can prove substancial loss through the cancellation of the contract. on the basis that your car still belongs to BMW UK and not the dealer at this moment in time , how can the dealer justify any losses? If the car was a really odd spec, then there are some grounds to retain part of the deposit toward potential losses if the car were to remain in stock for a long period of time (the car would go fully paid once 180 days in stock). So - in order to prevent said dealer from suffering a loss, tell him that TRL will gladly swap the car to his stock thus removing the only potential problem that they could face. Lower monthlies and less interest to pay, although that isn't going to be huge on a 4.9% APR if the difference is only a few grand.
As I said before, read the T&C's of the contract you signed. If the car is delivered and you don't collect within 14 days the contract is considered repudiated and the vendor can retain any deposit already paid. That's not to say they will, and most probably won't, they'll just give you a hard time about it. |
