That may be true but the cat absolutely must show ready. The cat showing not ready is an automatic fail in all states with emissions testing.

do you know if the spacer goes in the upstream hole closest to turbo side or the hole closest to the exhaust and vband to exhaust side ?

I have no personal experience with using o2 extenders or mini o2 cats. However, it’s the post-cat o2 locations (the holes closest to the midpipe/exhaust).

O2 spacers don’t seem to work with late model BMW. There are mini-cat O2 spacers that also have mixed results though I like the theory better.

The upstream, or O2-1 is the O2 that matters... The second one is just measuring difference pre and post cat. But O2-1 is measuring what the engine is doing, ie, fuel ratio, efficiency of burn cycle, ie, making sure engine air/fuel is reaching stoich...

Depending on what your tolerance is, there are ways to try and prevent the code while catless. Not sure on tuning availability with this platform but some 'older' platforms allowed for the turning off of code checks via the ECU, and would report all as normal. Not a good idea while driving of course, but for certain diagnostics, worked great. Get what I mean!? Unfortunately, newer ECU's or the programmers might not tweak these sections of an ECU either, so there's that. Down pipe really isn't hard to pop in/out and as a last resort, could just get the car up in the air, swap out the DP, drop a stock tune on it and get it inspected. Price of doing business...

Gotta PAY if ya wanna PLAY! Sometimes there's no easy way, but there's still a way!

Good Luck

*UPDATE * Anybody that said you couldn't pass with Catless downpipe AND A Tune was spreading misinformation. if your rocking a downpipe with MHD just click aftermarket downpipe in the MHD Menu. Drive around to ready the monitors and go get it inspected. Super simple

So it all worked out for you, good deal, even better that you shared the experience.

Good deal, here where I like, that's all the tech cares...if all monitors are ready, I am good.

Does anyone know if this is a feature on BM3, really don’t feel like adding a spacer to pass 🥲

It was a feature and maybe still is since BM3 is downloaded from outside the USA.

Not true. Only MHD tunes have an option to modify emissions settings in the ecu which is against the law. They’ve gotten away with it for now because they aren’t a US tuning company. No US tuner will alter ecu parameters to allow you to pass without cats. It’s not spreading misinformation. What you’ve done is against US law and you openly admit it. Way to go.

Here’s a link to the EPA emissions tampering:

Will they really bust down his door over an anonymous comment on an internet forum?

My issue with this sort of discussion in a public domain is not the FBI knocking down your door at 4AM, it's that the government might pick up on what people are doing to get around it and then make it harder to get around it. E.g. Adding a way for the OBDII software to compare the software checksums between stock and aftermarket tunes. This is already a reality in California.

They’re going after vendors for selling the smallest emissions mods including intakes. If someone were to say to the epa there’s a car forum openly discussing how to defeat emissions testing and effectively saying it’s “legal”, I could see them amending the document to stating any vendor, regardless of their location, must not defeat/alter emissions equipment in the ecu. To state telling the guy that passing emissions testing without cats is misinformation is a child who doesn’t know the effects of a catless system on emissions or doesn’t care what his contribution to global emissions is. It’s just him so how bad can it be? The problem is it’s NOT just him. What I don’t understand , BM3, Cary Jordan, BimmerWorld (actually they no longer sell tunes to state registered cars due to the epa), etc, sell stage 2 tunes that use stock cars. Don’t believe me, ask them. So other than wanting to be obnoxiously loud, there’s no reason to remove cats or if you do buy the AA EPA-certified HFC DP. You gotta pay to play properly.

I agree with most of what you said, talking about this stuff in public will just ruin everything for enthusiasts.
