If you have GAP and its a total loss and you walked away then it can't be a bad result I'm sure. You should come out of it financially ok and now can screw down the deal on the M3 as you have no trade in to complicate the deal.

Wow, sorry to read this. Glad all involved are OK and all of this on top of a loved one passing away......

Hopefully your GAP will see you alright and still get this (or another M3).

Ouch.... see what the insurance say I guess. Your best option will be for them to write it off so you can claim off your GAP.
Sounds like what you say, they'll write it off.

What did the dealer say where you're getting the M3 from?

He's going to see his manager to see if they would still take my car if it is repaired.If not I'll get my deposit back and weigh up my options.

I had a chat with the officer who dealt with the incident ,he was very understanding saying that although I could be prosecuted he wasn't going to take it further as he didn't want to inflict a court case on me after the week I'd just had.

Yes understand technically he could have been taken for an offence but in reality reckon it wouldn't happen too often especially as no one was hurt. Good to get confirmation from the copper though that they were adopting a sensible approach.

I still would, if the insurance company knows the circumstances they could quite easily wriggle out of the claim.....and just because the attending officer says he won't take it further, doesn't mean someone reading this might not open further enquiries. Better safe than sorry.

The car was going to go to an independent repairer.I rang Churchill and said the car was going to be part exchanged and therefore I wanted it to go to a BMW-dealer body shop ,and they said yes that's no problem and immediately cancelled tomorrow's collection by the independent and arranged for it to go to Sytner BMW Haverfordwest.The dealer I've bought the M3 from has said that if my car is repaired they will have to send it to auction so will reduce the offer they made for my deal.At the moment I am considering my options.

Sorry to hear about your week, I am local so if you want a trip out in my M3 or any other info let me know.

Hopefully all will be sorted with insurance and gap so you can proceed with the M3 deal. The only other thing to look at would be insurance on the M3 with a recent claim but can cross that bridge when you come to it...

When I'm at incidents like this, the way I deal with it is if no-one else is hurt then there's no point in prosecuting someone for the sake of it. Also a lot depends on the drivers attitude and if they are bullshitting me. If they turn round and are honest and say yep I fell asleep I'm sorry then I figure they've been punished enough and will learn from it.

Lie to me, or hurt someone else and I'll throw the book at you.
