BMW 1 Series F40 118i intermittent brake fault

Hi everyone

I recently purchased a 2019 BMW 1 series 118i M sport (F40 model). After a week or so of having the car a ‘brake light right failure’ came up on the dash and on my ‘my BMW App’. I took it back to where I purchased it from and they stated that they reset the light and if it happened again I would need a new tail light lamp due to the lamp being LED. So off I went and a few days later the fault came on again. The fault comes on intermittently and very often goes off when the car is switched off. It can come on several times a day and then it can go off for several days/weeks.

I again, returned the car back to where I got it from and they took it in for the day to be looked at by a master tech. They stated they had the light out and they checked the loom and wiring harness etc and couldn’t find a fault and that I should try to take it in when the fault is present…pretty tricky considering it’s intermittent!!. So, again I took the car away only for the fault to come back a few weeks later and come on continuously several times a day over the course of 3 days. We then plugged it into a basic diagnostic machine and the fault code ‘804874
Intermittent
Output, Brake Light, Outer right, faulty’

was stored. So I took a picture of this and sent it to the garage I brought it from, along with a video of the brake light failing. They then said they needed it back in to check over their work…I queried whether the BDC was an issue as they hadn’t coded the lamp in when they replaced it. They then decided they needed the car to go back to BMW. They called BMW for a quote and the sales manager decided it needed to go to a third party BMW specialists. I arranged for my car to be dropped in a week later, by this point the fault had now not been present for 2/3 weeks. The BMW third party specialists had it in and said that they couldn’t find a fault or a stored fault code. They looked at the fault code I had sent them and decided they would do a short circuit reset. I then received the car back and after having it back for around a week the fault came on again. So I contacted again, only to be told that there isn’t much that can be done without the fault present or the fault code stored.

I then requested to receive information about all the work that has been carried out to try and resolve the issue and I am still waiting to hear back. When driving the car today over relatively bumpy road surfaces the fault came up twice on 2 separate occasions and both after pressing the brake. I then tried to get it to come up again by going down a road with speed bumps later on but of course it didn’t come on!!

Sometimes when the fault is present and I press the brake continuously it fails to illuminate or gives a slight flicker I have attached a image of what happens when the fault it present and the brake pedal is under load.

Has anybody got any ideas what this could be? My gut feeling is wiring but the garage seem to believe this has been looked at and is fine? I’m at a bit of a loose end!!
