i am amazed by the lack of insurance knowledge in this thread.

i am a P&C agent and i might start one of those "ask an insurance agent anything" thread.

NC is not a no fault state (i don't think). if you involve your carrier, which it looks like you have (which was not necessary), go get your car fixed and pay your deductible and quit crying. your insurance company WILL subrogate, and they will win. you will most likely get your deductible back.
