Even in his email response, he admits to selling you tires less than described. Who gives a shit if he still thinks you got a good deal...he misrepresented the tires. He should have pulled the tires off himself and checked the depths with a simple coin prior to eyeballing them on the car and guessing 85%. What an asshole. Call your CC company immediately.
