I ran into this situation in 2012 when I bought my used 2011 335i from BMW of Beverly Hills. When I asked why it wasn't CPO, yet other used 335i's they were selling were, it was because this car was never privately owned. It went from the dealer lot unsold into the dealers fleet use as a service loaner. 9000 miles later I bought it and kept it until November last year.
