Its definitely safety related and I'm sure the NHTSA would like to know about this. A simple seat switch shouldn't fail that quickly (read defect). Now, once the car is well out of warranty, the seat switch should be just a switch, most likely open when nobody in passenger seat and closed when there is. I know what I'd do.
