I would play the situation honestly. It's your decision, but I really hope you don't fraudulently represent the incident.
I've had incidents that were "borderline" warranty issues with other cars and found that a straightforward, honest approach works best. Dealers have latitude on what they can warranty and the ability to fight for you with BMW should the need arise. Gain their respect and good things happen. It always has for me.
