To me it sounds like he is the one, this is a dealership we are talking about, a DVR hard drive crashed right after tech brought my car in?

So he cannot check any further. Smells funny to me.
Does not sound right. They probably used your car to shuttle people (employees/customers). I will call/complain to the General Manager (the service manager reports to him) and explain to him your displeasure. If that does not work, take it to BMW USA marketing/sales department (make sure you tell the General Manager you will do this). Then the next step is publish/write your comment to Better Business Bureau, LA Times, Car&Driver and other car magazines. I guarantee you will get some response.
